Heard learned Advocate for the Respondent Nos. 1 and 3. Respondent No.1 has expired and it is informed to the plaintiff-Kirit in the Administration Suit which was transferred to City Civil Court. 2.

Apart from that there are two testamentary petitions pending in this Court on the basis of two Wills alleged to be executed by deceased Kantilal. The present applicant Tarun is the defendant in a Administration suit. He has filed this application for transfer of Administration Suit to this Court.

It is submitted that Administration Suit got dismissed on account of non-removal of office objections.

One does not know what steps are taken by plaintiff-Kirit for restoration of that Administration Suit. In fact, the present application for transfer can also be filed if the Administration Suit is restored. Today no one is present for the applicant. One chance be given to them.
