Heard learned Advocate Shri.Kalel for the Applicant-Husband and learned Advocate for the Respondent-Wife who is appointed Advocate.

This Court is not inclined to transfer Domestic Violence case filed by the wife before the Court of Judicial Magistrate First Class - Panvel to the Court of Civil Judge Senior Division at Kalyan. At that juncture, Mr.Kalel made two requests. One is, matrimonial Petition be Satish Sangar 1/2

6-MCA-369-2024.doc transferred to Civil Court - Panvel and second, the Domestic Violence case in Panvel Court be transferred to Civil Court Panvel. 3.

He relied upon the observations in case of N.C.V. Aishwarya v/s. A.S.Saravana Karthik Sha1. If he wants, the said prayer to be considered, let him carry out the amendment and copy be served on other side. The Affidavit-in-Reply filed by the Respondent is taken on record.
