Applicant seeks transfer of the marriage petition from the Family Court at Nagpur to the Family Court at Thane. Applicant is residing in Kalyan with her mother and her brother. She is also entrusted with the care of her nephew who is the son of her brother, whose wife expired in July-2022. Hardship of the Applicant is of paramount consideration. Proximity of distance is also required to be considered as a ground in favour of Applicant. 3.

Respondent shall take cognizance of this order and the application and file his objection before the next date, failing which this Court shall determine the application in accordance with law. 7.

After receiving the notice, Respondent to file affidavit-inreply on or before the next date, if so desired with an advance copy to the Advocate for Applicant.

Respondent is directed to remain present either by himself or through his Advocate or through video conferencing on the next adjourned date. It is made clear that if Respondent remains absent despite service on the next adjourned date, this Misc. Civil Application shall be heard and disposed of at the stage of admission in the absence of the Respondent. 9.
