Heard Mr. Tamhankar, learned Advocate for Applicant and Mr. Pote, learned Advocate for Respondent.

Since cross Miscellaneous Civil Applications are filed by the parties before the learned District Court, Thane, the District Court, Thane seized of with custody proceedings shall defer the hearing of the same until the present Miscellaneous Civil Applications are determined by the Court.

Similarly, the Family Court Bandra seized of hearing the Marriage Petition shall also defer the proceedings until the present Miscellaneous Civil Application is heard and decided. 4.
The request made by Mr. Tamhankar, learned Advocate for Applicant in Miscellaneous Civil Application No.376 of 2024 is that the
929.MCA.376.2024.doc Respondent is presently serving in Canada and according to him an attempt should be made between the parties for settlement. If the parties give appropriate instructions to the learned Advocates, learned Advocates shall speak to each other before the next adjourned date and accordingly inform the Court, if the parties desirous of referring their lis to Mediation or otherwise.

Mr. Tamhankar, learned Advocate appearing for the Applicant in Miscellaneous Civil Application No.376 of 2024 would submit that he will also persuade his client for giving appropriate instructions in this regard.

At the request of both the learned Advocates for parties, Miscellaneous Civil Application (Stamp) No.24056 of 2024 filed by Respondent in this Application is directed to be clubbed and listed alongwith Miscellaneous Civil Application No.376 of 2024. 7.
