Heard the learned Counsel for the applicant.

The application is preferred to transfer a petition for restitution of conjugal rights being Petition No.A/1630/2023 filed by the respondent - husband before the Family Court at Bandra to the Family Court at Thane.

The applicant has instituted a petition for dissolution of marriage before the Family Court at Thane. The applicant has also filed a proceeding under the Protection of Women from Domestic Violence Act, 2005 in the Court of JMFC at Thane.

It would be expedient even in the interest of justice that the petition for dissolution of marriage and the petition for restitution of conjugal rights are heard and decided by the same Court.

In view of the above, with the consent of the parties, Petition No.A/1630/2023, pending on the file of the Family Court at Bandra, stands transferred to the Family Court at Thane for hearing and final disposal in accordance with law. 6.
The learned Judge, Family Court at Bandra shall transfer the record and proceedings in Petition No.A/1630/ 2023 to the Family Court at Thane within a period of four weeks from the date of communication of this order. 7.
In the meanwhile, the parties are referred to mediation by a Mediator to be appointed by the Secretary, District Legal Services Authority (DLSA), Thane.

The parties shall appear before the Secretary, DLSA, Thane, on 24th January, 2025.
