DATE : 15 SEPTEMBER, 2025 P.C. :- 2) It is the case of the applicant that out of her wedlock with respondent, there are two children born, one is 13 years old girl child and another is son of 8 years who is a special child. The respondent is Assistant Police Inspector. The applicant is staying alongwith her mother-in-law at Pune and the Respondent is staying near Mumbai at Mira-Bhayander and is posted at Mira Bhayander Police Station. It is alleged that the Respondent is in illicit relations with a lady for last several years.

2) On behalf of the Respondent, it is submitted that the

2/3 Respondent has already gifted his share in the house at Pune, 50% to his wife and 50% to his mother. It is further submitted that he is suffering from cancer and is undergoing treatment and therefore he should be permitted to attend the Court hearing through virtual mode and whenever his presence is required, he will attend the Court physically.

3) After the matter was argued for some time, both the learned Advocates agree that the application can be disposed, and proceedings can be transferred to Civil Judge Senior Division at Pune. 4) The present Miscellaneous Civil Application is allowed in terms of prayer clause (b) which reads as under :- (b) This Hon'ble Court be pleased to transfer the Petition No. A - 753 of 2022 from the Court of Hon'ble Family Court Bandra at Mumbai to the Hon'ble Jt.C.J.S.D. & Add. C.J.M. Pune. 5) Once the Petition No. A-753 of 2022 is proceedings are transferred to the Civil Judge Senior Division, Pune, the hearing of the same would be expedited and attempt be made by the Civil Judge Senior Division, Pune that the same be disposed off, by end of December 2026.

6) The parties through their advocates agree that they will co-operate with the hearing of the petitions and will no sought

7) The respondent husband is permitted to attend both hearings through virtual mode and whenever necessary, he will attend the proceedings physically in the Court.
