DATE : 14 NOVEMBER, 2025 P.C. :- 1) On 18 September, 2025, following order was passed :- 1) Ms.Deshmukh, learned Advocate appearing for the applicant submits that this Court by its order dated 13 December, 2024 granted liberty to the applicant (wife) to appear before the Family Court at Nagpur through video conferencing. She submits that the order dated 13 December, 2024 passed in Miscellaneous Civil Application No. 400 of 2024 was not communicated to the Family Court at Nagpur. Hence, the proceedings before the Family Court proceeded further and an ex-parte decree has been passed against the applicant. She submits that the applicant needs to take steps to quash the order passed by the Family Court at Nagpur. Hence, the present MCA should not be disposed off and be kept alive.

2) Mr.Pawar, learned advocate appearing for the applicant submits that earlier in the present proceedings dated 13 December,

KVM 2/2 47 - MCA 400 OF 2024.doc 2024 while this Court directed to the applicant to appear before the Family Court through V.C., he submitted that the order dated 13 December, 2024 was not communicated to the Family Court at Nagpur. Therefore, the Family Court proceeded further with the hearing of the Petition No. A/324/2024 and passed an ex-parte decree of divorce. He submits that his office is not able to contact the applicant. Therefore, some more time may be granted to him to contact the applicant.
