DATE : 15 SEPTEMBER, 2025 P.C. :- 1) After hearing learned Advocates for both the sides for some time, both the learned Advocates agree that the present Miscellaneous Civil Application, requires to be allowed as though the wife has filed two proceedings, one, under Section 125 of the Criminal Procedure Code and another under the Domestic Violence Act, before the Court at Jalgaon, at present her son aged 8 years is studying in a school at Navi Mumbai. The husband the present applicant has filed a section 9 proceedings before the Family Court at Belapur. The
2/3 husband is seeking transfer of wife's proceeding filed before the Jalgaon Court to the Family Court at Belapur. 2) Hence, by consent, the present Miscellaneous Civil Application requires to be allowed.
3) Miscellaneous Civil Application is allowed in terms of prayer clauses (a) and (b) which reads as under :- (a) that this Hon'ble Court be pleased to transfer Petition No. E-117 of 2023 from the Family Court at Jalgaon to Family Court at Belapur, Navi Mumbai. (b) that this Hon'ble Court be pleased to transfer the Domestic Violence case No. 257 of 2023 from the Court of Judicial Magistrate First Class Jalgaon at Jalgaon to Family Court at Belapur, Navi Mumbai. 4) The hearing of the petition bearing no. A-69/2023 pending before the Family Court at Belapur alongwith two transfer petitions being No. E-117 of 2023 and DV Case No. 257 of 2023, is hereby expedited.
5) At the request made by both the learned Advocates on instructions from clients, the dispute between the parties is referred to mediation to the learned Senior Advocate, Mr. S.G.Deshmukh, an advocate practicing in this Court. The address and contact number of
