DATE : 18 DECEMBER, 2025 P.C. :- 1) By an order dated 26 September, 2025, the following order was passed :-

1. This is a transfer application filed by the applicant - wife, seeking transfer of Petition filed for restitution of conjugal rights by the respondent-husband in the Family Court, Pune to the Family Court at Bandra, Mumbai.

2. After this matter was argued for some time, learned counsel for the respondent-husband, on instructions, fairly states that though the respondent-husband is staying in Pune, he will have no objection if the matter is transferred to the Family Court at Bandra, Mumbai, since their son of one and half year old is staying with the applicant -wife in Mumbai.

3. The Misc. Civil Application stands allowed in terms of prayer clause (A).

4. The Family Court at Pune is directed to transfer the proceedings of P. A. No.847 of 2024 to the Family Court at Bandra, Mumbai, within a period of four weeks from today.

2) However as far as the dispute between the parties are concerned, at the request of the parties, the same was referred to the mediation. Today the matter is kept on board only for the purpose of assessing the mediation report.

3) The learned arbitrator has sent his report in a sealed envelope. On opening the said mediation report dated 22 August, 2025, mentions that the 'mediation has failed'. The said mediation report is kept in file. The Family Court at Pune and Family Court at Bandra, Mumbai to follow the instructions given in the order dated 26 September, 2025 passed in Miscellaneous Civil Application No. 460/2024.
