This Miscellaneous Civil Application is filed by the Applicant husband under Section 24 of the Civil Procedure Code 1908, for transfer of Marriage Petition No.665 of 2022 and Misc. Application DV No.314 of 2022 from Vasai District Court to Family Court at Bandra.

The learned Advocate for the Respondent submits that she has no objection if the proceedings between the parties are transferred from Vasai Court No.1, Civil Judge, Senior by SANDHYA BHAGU WADHWA Date:

6-MCA-470-2024.DOC Division, Vasai to Family Court at Bandra where the Marriage Petition No.A-767 of 2023 is filed.

Upon hearing both the learned Advocates, I pass the following order:- (i) Application is allowed in terms of prayer clause (a) and (b).

(ii) The Court at Family Court, Bandra, may permit the Respondent to appear via Video Conferencing if permission is sought and her physical presence is not absolutely necessary. (iii) The transfer may be effected within a period of four weeks and upon receipt of the papers and proceedings the Family Court, Bandra, shall give notice to the parties, preferably within three weeks to proceed with their respective matters.

(iv) Parties to act on an authenticated copy of this order. (Kamal Khata, J.)
