This matter is called out in morning session, when the counsel for both the parties made submissions. 2.

The advocate appearing for the Respondent wife informed this Court there are arrears of interim maintenance against the Applicant of approximately Rs.50,00,000/- and before the Applicant makes further submissions he should be directed to pay the arrears. On such submissions made by the counsel appearing for the Respondent, the Advocate appearing for the Applicanthusband sought a short keep back, in order to permit the Advocate to take instructions from his client, regarding timeline for payment of the outstanding interim maintenance amount. When the matter is called out in the post lunch sessions, the counsel appearing for the Applicant made submissions that he wants to withdraw the transfer application.

Since the Applicant wants to withdraw the transfer application the said request cannot be rejected and has to be allowed. However, looking at the conduct of the Applicant and his Advocate I think it appropriate to impose cost on the Applicant. 4.

Hence, the Miscellaneous Civil Application stands rejected with a cost of Rs.1,00,000/- to be paid to the Respondent within a period of two weeks from today.
