Heard learned Advocate for the Applicant-wife. 2.

The Respondent-husband has filed a Divorce Petition pending before the learned Civil Judge, Senior Division-Panvel. It is at the stage of ex parte hearing. The Applicant-wife is seeking transfer of the same to the Family Court at Pune.

The reason behind transfer is, there is a proceeding filed as per the provisions of Domestic Violence Act at Pune. It is submitted that there is likelihood of passing an ex parte order by the Panvel Court in Divorce Proceeding.

Today, the matter is fixed before the Panvel Court. It is made clear that let, the Applicant-wife should file an Application before the Panvel Court for setting aside ex parte order . Once, that Application is filed, let the Panvel Court should not pass any further order. 5.

Parties to act on an authenticated copy of this order. 6.

This direction is given only under the assumption that the proceeding is not disposed of.

Issue notice to Respondent-husband returnable on 7th February 2025.
