This Miscellaneous Civil Application is filed by the Applicant-husband under Section 24 of the Civil Procedure Code 1908, seeking transfer of PWDVA Application No.3 of 2023 pending before the learned JMFC & CJJD Court, at Raver, Jalgaon to learned Magistrate Court at Nashik. 2.

Accordingly, I pass the following Order:

i.

MCA is allowed in terms of prayer clause (a). ii.

The transfer shall be effected within a period of four weeks. Upon receipt of the papers and proceedings, the learned Magistrate Court, Nashik shall issue notice to the parties, preferably within three weeks, to proceed with their respective matters.

iii.

The learned Magistrate Court, Nashik may, at its discretion, permit the Respondent to appear via Video Conferencing, if such permission is sought and her physical presence is not absolutely necessary.

iv.

All concerned to act on an authenticated copy of this Order.
