DATE : 26 SEPTEMBER, 2025 P.C. :- 1) Mr.Udane, learned advocate appearing for the applicant - husband submits that the respondent-wife has filed four proceedings against the applicant husband viz., (1) petition for restitution of conjugal rights at Solapur, (2) complaint under Section 125 of the Criminal Procedure Code at Solapur, (3) D.V. proceedings at Solapur and (4) Section 498 proceedings at Pune.

2) He submits that the first three proceedings filed by the wife were transferred from Solapur to Pune pursuant to the order passed in Miscellaneous Civil Application Nos. 21, 12 and 18 of 2020 by order dated 18 August, 2021.

KVM 2/2 29 - MCA 559 OF 2024.doc 3) He submits that out of the wedlock of the applicant with the respondent, there are two children born, who are residing with the applicant husband from December 2023 pursuant to the order passed in the custody petition. He submits that the divorce proceeding has been filed by the applicant husband before the Family Court at Pune and the restitution petition filed by the wife is also pending before the Family Court at Pune. So also, Section 125 Criminal Procedure Code proceeding filed by the wife has been transferred to the Family Court at Pune. Therefore, it will be convenient for both the parties, if the D.V. proceeding filed by the husband are transferred to the Family Court at Pune from Judicial Magistrate First Class, Pune. 4) Office remark shows that the respondent has been served. However, none appears for the applicant when the matter is called out.

5) Stand over to 14 October, 2025. Matter to come up for final disposal.

6) The applicant is directed to inform the respondent that now the matter is kept for final disposal on 14 October, 2025. [RAJESH S. PATIL, J.]
