Heard the learned counsel for the applicant.

This application is filed seeking transfer of Hindu Marriage Petition No. A-353 of 2022 pending on the file of Civil Judge, Senior Division, Nashik to the Family Court, Nashik Road at Nashik. 4.

The applicant has filed an application for award of maintenance under section 125 of the Code of Criminal Procedure, 1973 before the Family Court, Nashik Road at Nashik being Petition No. A-191 of 2022. The applicant thus seeks transfer the Marriage Petition as well to the Family Court at Nashik 5.

Both the Courts are at the same station. The learned counsel for the respondent submits that the respondent has no objection to allow the application.

ORDER

1] The application stands allowed in terms of prayer clause (b). 2] The Petition No. A-353 of 2022 stands transferred from the file of Civil Judge, Senior Division, Nashik to the Family Court, Nashik Road at Nashik.

3] The learned Judge shall transfer the record and proceedings in A-353 of 2022 with such dispatch that it reaches the Family Court, Nashik Road at Nashik within a period of four weeks from the date of communication of this order.
