On previous date, learned AGP had informed that the order of which non-compliance is alleged is under challenge before the Hon'ble Supreme Court. The status has not been not disputed by the
2 cp 29.25.odt petitioners. That being so, it will not lie in the mouth of the petitioners to allege willful disobedience of the order under question. 2.
As such the learned Counsel for the petitioners submits that the Hon'ble supreme Court has not granted stay and therefore the respondents are bound to comply with the said order. In our view, this is an aspect for which the petitioner may avail the remedy of filing the recovery proceeding. The question before us is whether the action of the respondents of non compliance of order amounts to willful disobedience thereof. It is one thing to say that the order has been not complied with and it is another to say that there is willful disobedience of the order. In the entire petition, the petitioners have not pleaded the conduct of the respondents indicating willful disobedience of the order. 3.
What we find is that the respondents are aggrieved by the order passed by this Court and have accordingly challenged the same before the Hon'ble Supreme Court. The Hon'ble Supreme Court thought it proper to issue notices and thus not to dismiss the petition in limine. Thus, the respondents are hopeful that a different view may be taken by the Hon'ble Supreme Court. In the circumstances, the petitioners cannot allege that the conduct of the respondents is such that would attract action under the Contempt of Courts Act. The contempt petitions are accordingly dismissed.
