The petitioner pointed out that this court by order dated 7.3.2022 specifically observed that in case the petitioner's contract is renewed or he enters into another contract with another company, the petitioner shall be under an obligation to disclose the same before the trial Court and to place the copy of the same before it, considering which it would then be permissible for the learned JMFC to pass appropriate order in that regard.

It is thus clear from the order of this court that at the time of passing order, respondent contract of service was not renewed nor according to this court he was in other employment. However, the petitioner demonstrated from the documents placed on record that on the date of passing of this order, the respondent was in possession of order of appointment from private company namely, MCDERMOTT, dated 17.2.2022 but the said fact was not disclosed to this court. Furthermore,

2 24cp53.24.odt as per the directions of this court, after getting appointment also, he has not disclosed this fact before the trial court. 3.

The learned counsel for the respondent Advocate Shri B.G. Kulkarni states that the respondent has taken back the brief from him.

In the circumstances, issue bailable warrant against the respondent in the sum of Rs.20,000/- which is made returnable on 11.11.2025. The concern Police Station of the area wherein the respondent is residing should take care to serve the bailable warrant on the respondent within given time period.
