The petitioner contends that the respondent authorities have not appointed the petitioner in the post of constable pursuant to the order dated 16.07.2024 passed in Writ Petition No. 1637/2024 and, thereby, failed to comply with the order, therefore, liable for contempt proceedings. 3.

We have gone through the order dated 16.07.2024 in Writ Petition No. 1637/2024. We would like to reproduce the relevant observations in para no. 8 of the said order, which read thus as under:- "8.

The petitioner, if found otherwise qualified, appointment order can be issued as already post is directed to be kept vacant by an interim order." 4.

The order denotes that an appointment order can be issued if the petitioner is otherwise qualified. By a RR Jaiswal

2 3-cp-321-24.odt communication dated 03/13.09.2024, the petitioner was informed that the marks obtained in the written test were below the cut-off marks, which indicates that the petitioner was not qualified for appointment to the said post. 5.

In view of the above, we do not find any substance in the petition, and it is bereft of merit. Consequently, the notice is discharged.
