The matter was placed on board today pursuant to a mentioning made by Learned Counsel for the Petitioner.

Learned Counsel for the Petitioner invited my attention to the order dated 13 th November, 2024 and today requested that since both the parties to the contract are based in Pune, an Arbitrator based in Pune be appointed as an Arbitrator in place and stead of Ms. Akanksha Agrawal, who was appointed earlier by this Court. He has invited my attention to the jurisdiction clause which also provides for the Courts in Pune to have jurisdiction. He submits that though the arbitration clause does not speak of any venue, since the parties are based in Pune, it would be convenient for this Court to appoint an Arbitrator from Pune. Shubham 1/2

Thus, I appoint Mr. Sanjeev S. Sharma, Former District Judge to act as an Arbitrator in respect of the disputes and differences between the parties in place and stead of earlier Arbitrator on the same terms.
