This is a Petition under Section 11 of the Arbitration and Conciliation Act, 1996 ("the Act").

Learned Counsel for the Petitioner clarifies that no suit has been filed in the District Court. What has been filed in the District Court is a Petition under Section 9 of the Act, and therefore, there is no question of the Respondent raising an objection that the Petitioner has given a go-by to the arbitration agreement.
