Since the dispute in the present case is between the flat purchaser and the developer. Mr Sawant, Learned Counsel appearing on behalf of the Petitioner submits that the Petitioner was not desirous of retaining the flat since it is his contention that the said flat is not habitable. He submits that if the Respondent-Developer makes an offer and repurchase the said flat from the purchaser, the entire dispute or issue can be resolved.

Mr Das, Learned Counsel appearing on behalf of the Respondent submits that his client is not interested in repurchasing the flat but will
