When the matter was called out, Learned Counsel appearing on behalf of the Respondent submitted that he had only just been SHEPHALI SANJAY MORMARE Date: 2024.09.27 14:58:15 +0530 instructed to appear. Learned Counsel appearing on behalf of the Petitioner points out that this Petition is filed for substitution of the Arbitrator. He invites my attention to a very distressing state of affairs by submitting that this is the third Petition that has been filed for substitution of Arbitrator since on two previous occasions both Arbitrators appointed had recused themselves on account of allegations made by the Respondents. This is indeed a most unfortunate and worrying trend, which cannot be permitted to be countenanced at any costs.
