After hearing Learned Counsel at some length, Mr. Patil, Learned Counsel for the Respondent invited my attention to the fact that the agreement containing the arbitration clause which had been invoked by the Petitioner was entered into between the Respondent and one Rajuseth Mansuklal Ruparalia in his capacity as a Karta for R. M. Ruparalia HUF. He pointed out that the Petition, however, has been filed by Mr. Rajuseth Mansuklal Ruparalia in his capacity as the sole proprietor of one Rasmi Marketing. It is his submission that the Petitioner is not same parties/individual party to the agreement as arrayed in the cause title. He thus seeks leave to file an additional Affidavit placing this on record. The same be filed on or before 6 th January, 2025.

These submissions, I must note, are without prejudice to the contention that the agreement itself is admittedly unsigned. 3.
