It is pointed out that in the written statement, filed in the suit by the present applicant/defendant, he has contended that the suit has not been properly valued for the purpose of Court Fees and Jurisdiction. In view of this factual position, the Court would be required to frame an issue to that effect and conduct an inquiry as provided under Sections 8 and 9 of the Maharashtra Court Fees Act, 1959.

In view of this, learned advocate for the applicant seeks leave to withdraw this application with liberty to agitate the issue as to the valuation of the suit for the purpose of Court Fees and Jurisdiction.

Leave is granted with the liberty as prayed for. 4.
The application is disposed of as withdrawn. No order as to the costs.
