DATED :- 10.09.2024 The learned counsel for the appellant submits that the Motor Accident Claim Tribunal, Gondia has rejected the claim petition of the appellant on the ground that there is doubt regarding motor accident.

The learned counsel for the appellant tender across the bar an award passed in MACP No. 105/2027, decided on 02.05.2023 of the Tribunal in another case, arising out of the same accident, by which the said petition came to be allowed. It is also submitted by the learned counsel for the appellant that the Insurance Company has satisfied the claim in that petition.

The learned counsel for respondent no. 1 seeks time to take instructions in the matter.
