AUGUST 13, 2025 1) The applicants/appellants have filed this application for the grant of permission to withdraw the entire amount deposited by respondent No.3, for which learned counsel for respondent No.3 has given no objection, as the appeal is partly allowed by order dated 23/07/2024. The applicants have also urged to permit applicant No.1 Kantabai wd/o Panjab Borchate to collect the amount on behalf of applicants No.2 to 5. 2) It also appears that applicants No.2 to 5 have executed a special power of attorney in favour of applicant No.1, thereby authorising her to collect the entire compensation amount on their behalf in her account.
3) Having considered the reasons disclosed in the application, no objection given by learned counsel for respondent No.3, as well as the fact that the applicants No.2 to 5 are the daughters of applicant No.1, the application is allowed as prayed.
2 18-CAF 2932.2025.odt 4) The Registrar (J) is directed to transmit the entire amount of compensation, along with interest accrued thereon, to the bank account of applicant No.1 Kantabai wd/o Panjab Borchate within six weeks on her furnishing bank account details to the Registry.
5) The applicant No.1 is directed to file an affidavit before the Registry of this Court about the distribution of the compensation amount to the applicants No.2 to 5 as per the Award, within three weeks of receipt of the amount in her bank account.
