CORAM : A.S. CHANDURKAR & RAJESH S. PATIL, JJ DATE : 23rd AUGUST, 2024 P.C. :- The petitioner seeks review of the order dated 12th July 2024 in Writ Petition No. 9416 of 2024.

In the aforesaid writ petition, prayer clause (a) reads as under :- a.

By suitable judgement, order or directions in

2/4 the nature of writ this Hon'ble High Court be pleased to direct The Chairperson, Maharashtra Administrative Tribunal, Mumbai to constitute a Division bench consisting of Shri. Justice P. R. Bora, (Vice-Chairman and Member Judge) who is sitting at MAT, Aurangabad bench and Shri. Debashish Chakrabarty (Member Administrative), who is sitting at MAT, Mumbai and further direct this bench to hear and decide the case of the Petitioner expeditiously, in the best interest of justice, forthwith.

On 12th July 2024 this Court disposed of the writ petition by passing following order :- 1] Respondent No.1 is present in Court today. On instructions, she submits that on 5th July, 2024 the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel & Training of the Government of India has appointed a Judicial Member as well as an Administrative Member at the Maharashtra Administrative Tribunal. It is further submitted that on these Members joining their respective posts, the Original Application preferred by the petitioner would be taken up for consideration.

2] In view of aforesaid, the grievance raised by the petitioner in person is resolved.

3] The petitioner in person is at liberty to move the Tribunal to seek expeditious adjudication of Original Application No.122 of 2024.

4] The writ petition is accordingly disposed of.

The respondent no.2 is present in Court today. He has tendered copy of the order dated 22nd August 2024 passed in the Original Application preferred by the petitioner. The same reads as under :- Today the present matter was taken up for hearing by Video Conferencing. Hon'ble Member (A) Shri Nitin Gadre joined on Video Conferencing from Nagpur Bench. Shri V.R Bhumkar, learned Presenting Officer joined on Video Conferencing from the office of Chief Presenting Officer. Aurangabad. The applicant is, however, absent.

The office has informed that the applicant has sent Email praying for next date in the matter and also prayed for physical hearing. Considering the request of the applicant and considering the availability of the Members on the Bench, as well as, learned Presenting Officer, the matter stands adjourned to 13.09.2024 at 3.30 p.m.

The applicant may remain present at M.A.T.. Bench at Aurangabad to make his submissions. Hon'ble Member (A) Shri Nitin Gadre would join on V.C.

Having heard the petitioner in person, we do not find any error apparent on the face of the record. In view of the

4/4 aforesaid, there is no merit in the Review Petition. It is accordingly rejected.
