Heard Mr. Anand Bhandari, learned Advocate for Applicant and Mr. A. S. Bajaj, learned Advocate for Respondent No.1-Caveator. 2.

Mr. Bhandari points out that suit has been instituted in the year 2023, by which sale deed executed in the year 1993 is assailed on the ground of fraud. He submits that Plaintiff himself is executant of sale deed and cause of action shown in plaint to make out the fraud is illusory and deceptive.

Having considered submissions advanced, issue notice to Respondents, returnable on 27th January 2025.
