The counsel for the respondent submits that the tax effect in appeal is below two crores and therefore the appeal ought to have been withdrawn in terms of Circular No.9/2024 dated 17th September 2024. The counsel further submits that the appeal does not fall in the exception.

The counsel for the appellant was requested to take instructions and make submissions. In response, the counsel for the appellant submits that he is awaiting written instructions. We need not wait for written instructions. The appeal is covered by the said Circular.
