he parties to this petition have iled pursis seeking speaking to minutes of order in invitum. he same is taken on record and is incorporated herein:
A.) he parties to the present application agree that the bye-laws of North and South Goa Societies will be modiied/amendment by following the necessary procedure as per law by incorporating only a speciic provision which states that the members of respective societies shall be appointed through election process in terms of Rule 3 sub rule 2(i) of he Prevention of Cruelty to Animals (Establishment and Regulation of Societies for Prevention of Cruelty to Animals) Rules, 2001.
B.) he necessary election for the post of 2 members of the respective North and South Goa Societies shall be carried out by following an election programme within a period of 30 days from the date of order passed disposing the present application and such elected member shall accordingly be inducted/included in respective societies.
C.) he amendment to byelaws shall be proposed before the General Body, suitable amendment to the byelaws shall be brought in force by following the due process of law. D.) he working of present managing committee shall not be disturbed and the said committee will continue to operate for the relevant term. he new members shall however be inducted after being duly elected.
Proposed amendments are as under:
For South Goa, DSPCA
1) Before Clause 9 (a) of the Bye-laws the following shall be added: he managing committee of the SPCA shall consist of the following members:
District Collector (South) Chairman Additional Collector (South) Vice Chairman Superintendent of Police (South) District Deputy Director Animal Husbandry & Veterinary Services, South Goa Member Secretary 5.
Chief Executive Oicer, Margao
Municipal Corporation 6.
2 Members representing Animal Welfare Organisations which are actively involved in the work of prevention of cruelty to animal from within the district.
Nominated Members 7.
Dy Director of Panchayat (South) 8.
District Assistant Director, Animal Husbandry. (South) Executive Secretary 9.
District Education Oicer.
(South) 10.
District Transport Oicer.
(South) 11.
1 Representative of the State Animal Welfare Board Nominated Member 12.
2 prominent persons concerned with animal welfare to be nominated by the Management Committee.
Nominated Member 13.
2 Members shall be persons elected by the General Body of members of the Society.
Elected Members Clause 9 (b) of the Bye-laws shall be amended as under: "he term of oice for the Management Committee Members shall be 3 years or till the period of New Management Committee is constituted. he elections of the 2 members to the New Management Committee, from the general body of the society should take place and the results are to be declared 1 month prior to the expiry of the term of the Management Committee. he list of Members of the New Management Committee has to be sent to the State Government to be notiied in the Oicial Gazette 15 days prior to the expiry of the term of the Management Committee."
