Though the application for condonation of delay for bringing legal representatives of respondent No.4 has been opposed, the reason cited in the application, i.e. due to the sickness of the Advocate for the applicant, appears to be genuine. For this reason, the delay in bringing legal representatives of Respondent No.4 on record is condoned. The 21st November, 2025
MCA 319 of 2025 Miscellaneous Civil Application is allowed.
3. The cause-title of First Appeal No.53 of 2023 shall be amended and the legal representatives 4(c) and 4(d) shall be impleaded as Appellants No.1 and 2 and legal representatives 4(e), (f) and (g) shall be impleaded as Respondents No.4, 5 and 6 in the Appeal. Amendment to be carried out forthwith.
4. Issue notice to the newly added Respondents No.4, 5 and 6 in the Appeal, returnable on 12.01.2026.
In addition to the regular mode of service, the Respondents may also be served through Speed Post A.D., email, WhatsApp and courier and the affidavit of service placing onr ecord the tracking report of the Speed Post AD/printout of WhatsApp and email messages as proof of service shall be placed on record on or before 09.01.2026.
