By this application, the applicant seeks transfer of Marriage Petition No. 139/2023 filed by the non-applicant and pending on the file the learned Civil Judge, Senior Division (CJSD), Vadgaon Maval, Dist. Pune, to the file of the learned CJSD, Khamgaon, Dist. Buldhana, where the applicant has filed a petition for restitution of conjugal rights.

It is contented that the proceedings under Section 125 of the Code of Criminal Procedure is also filed before the learned JMFC, Khamgaon by the applicant and she has no source of income to suffer the litigation cost and to and fro expenses to attend the proceedings at Vadgaon Maval, Dist. Pune.

Issue notice to the non-applicant, returnable within three weeks.

In the meanwhile, the proceeding before the learned CJSD, Wadgaon Maval, Dist. Pune is stayed till the next date of hearing.
