The application is filed for transfer of Hindu Marriage Petition bearing No.142/2021 pending on the file of Civil Judge, Senior Division, Gondia to Family Court at Nagpur.

Learned Advocate for the applicant states that the applicant is staying with her son who is 5 years of age and they are residing at Nagpur. Since 2023 the applicant is attending the Court at Gondia. It is difficult for her to attend the Court at Gondia which is about 160 kilometers away from Nagpur. The applicant is not earning and it is difficult for her to take her child with her and to bear the travelling charges from Nagpur to Gondia. Hence she has prayed to transfer the matter at Family Court, Nagpur.

Learned Advocate for the non-applicant has requested for adjournment as there is a possibility of settlement between the parties. Learned Advocate for the applicant states that though he enquired today with his client, he has no instructions about the settlement talks.

Considering the pendency of Hindu Marriage Petition since 2021 at Gondia and inconvenience caused to the applicant and her son to travel from Nagpur to Gondia, the divorce petition which is pending before the Civil Judge, Senior Division, Gondia is transferred to Family Court at Nagpur.

Application is allowed in above terms.
