The applicant has filed this application to transfer the petition A.679 of 2023 pending on the file of Family Court, Nagpur to the Court of Civil Judge Senior Division, Gondia, which is filed by the non-applicant for divorce.

The learned counsel appearing for the applicant has stated that the applicant is staying at Gondia. She has filed the application for maintenance before the Judicial Magistrate First Class, Gondia. She is staying at Gondia. Due to her health condition, she has to attend the Court along with escort. The non-applicant is staying at London and he has given power of attorney to his father.

The learned counsel appearing for the nonapplicant has stated that the applicant is staying at London and he can appear through Video Conferencing at any Court, if the permission is granted to attend the Kavita
59-mca 71-24.odt 2/2 proceedings through Video Conferencing, he has no objection to transfer the matter from Family Court, Nagpur to the Court of Civil Judge Senior Division at Gondia.

Heard both the learned counsel.

As the non-applicant is not staying in Nagpur and is ready to appear through Video Conferencing before the District Court at Gondia and considering the health condition of the applicant, the application is allowed.

The Petition A. No.679 of 2023 pending on the file of Family Court, Nagpur be transferred to the Court of Civil Judge Senior Division, Gondia. 7.
Civil Application stands disposed of.
