This is an application under Section 11(6) of the Arbitration and Conciliation Act for appointment of Arbitrator to decide a dispute arising out of the contract and in terms of clause-2.21.1.

The learned counsel for the applicant would submit that since a dispute arose between the parties and in spite of requests made to the non-applicant for resolving the said dispute amicably vide letters dated 07/04/2022 and 10/03/2022, there was no response. Finally, notice dated 08/12/2023 was issued by invoking arbitration clause. Till date there is no response from the non-applicant. 4.

Issue notice to the non-applicant, returnable on 05/04/2024.

Apart from regular service, service by other mode is permitted.
