This Miscellaneous Civil Application is filed by the applicant to transfer the Special Marriage Petition No.05 of 2023 pending before the Ad-hoc District Judge1 and A.S.J. Achalpur to Family Court, Nagpur. 2.

The learned counsel for the applicant has stated that, the joint petition is filed by the applicant and the non-applicant before the Adhoc District Judge-1 and A.S.J. Achalpur for divorce by way of mutual consent. 3.

Now, the applicant has changed her mind and wants to withdraw the consent for mutual consent. She has stated that, when she went to the Court of Ad-hoc District Judge-1 and A.S.J. Achalpur, the non-applicant beat her and she has lodged non-cognizable offence against the non-applicant, and, therefore, prayed to transfer the Special Marriage Petition No.05 of 2023 pending before the Ad-hoc District Judge-1 and A.S.J. Achalpur to Family Court, Nagpur.

Heard both the learned Counsel.

The joint petition is filed before the Ad-hoc District Judge-1 and A.S.J. Achalpur. The only stage in this consent petition is for recording of statement. The applicant can appear before said Court for withdrawing her consent through video-conferencing. Her advocate also can appear in person before said Court. Therefore, there is no need to transfer the matter for only one date. 6.

The Misc. Civil Application is rejected and disposed of accordingly.
