By this application, the applicant, who is the appellant in First Appeal No. 653/2022 has filed the present application for restoration of the First Appeal. 3.

The appeal came to be dismissed for noncompliance of filing of paper-book. The order dated 05.01.2024 passed by this Court was conditional one that in case of non-filing of paper-book within stipulated time, the appeal stands dismissed.

Considering the reason mentioned in the application, coupled with the fact the contents of the application remain un-controverted, as the nonRR Jaiswal

Hence, First Appeal No. 653/2022 is restored to file subject to condition that the appellant shall file paper-book within one week.

The application is allowed in the above terms.
