The application is filed for transfer of Marriage Petition bearing No.A-379/2023 pending on the file of Family Court Akola to the Family Court Amravati. The applicant is a lady and she has no source of income. She claims that it will be inconvenient for her to appear before the Family Court Akola.

It is the contention of the counsel for the applicant that there are two other proceedings filed by the applicant against the respondent which are pending in the Court at Amravati. 3.
Learned counsel for the respondent vehemently opposed the application. He has denied the allegations made against him by the applicant. It is his submission that the distance between two places is hardly 100 Kms.

The law on the point of transfer of the proceeding is settled to say that the convenience of the wife should be considered over the husband. Here in this case admittedly two other proceedings are filed pending between the parties in the Court at Amravati. In any case, therefore, the respondent will have to appear and attend the said proceeding. No prejudice, therefore, is likely to
