This is an application for transfer of Hindu Marriage Petition No.182/2024 pending on the file of 5th Joint Civil Judge, Senior Division, Chandrapur to the Court of Civil Judge, Senior Division, Wardha.

It is stated that the applicant is residing at Wardha. She has 17 years old son. She is looking after her son. The son is preparing for NEET Examination. The distance between Wardha and Chandrapur is 135 km. There is no direct connectivity. It is therefore, submitted that in order to obviate inconvenience caused to her the
22 mca tr. 535.24.odt..odt 2/2 proceeding may be transferred from Chandrapur to Wardha as prayed for.

I have gone through the proceedings. It is apparent that there is substance in the application. The non-applicant has not filed the reply despite service. The statements have gone unchallenged and uncontroverted. On the basis of the facts stated in the application, the applicant has made out the case for transfer. It is to be noted that in such proceeding, the Court has to consider the convenience of the wife. Accordingly, the application deserves to be allowed. Hence, the following order:-
ORDER
i) The application is allowed.
ii) Hindu Marriage Petition No.182/2024 pending on the file of 5th Joint Civil Judge, Senior Division, Chandrapur be transferred to Civil Judge Senior Division, Wardha.
iii) The application stands disposed of in the aforesaid terms. No order as to costs.
