By this application, the applicant - wife is seeking transfer of the matrimonial proceeding pending in the Court of Family Court, No.3, Nagpur to the Family Court, Amravati.

Learned Counsel for the applicant submitted that though notices are issued on the given address, but the non-applicant is avoiding the service. He is attending the proceeding before the Court and therefore, he be permitted to serve the non-applicant through his Counsel. The paper publication is already filed on record which shows that after paper publication also the non-applicant has not appeared before this Court.

Considering the peculiar facts of this case, the applicant is permitted to serve the Counsel of the non-applicant.
