The applicant has filed this application to transfer the divorce petition bearing No.71/2023 which is pending before the Kelapur Court to Gadchiroli Court.

Learned Advocate for the applicant states that the applicant is staying at Armori which is about 34 kilometers away from Gadchiroli. It is difficult for the applicant to travel from Armori to Kelapur. It takes near about six hours and she has to change three to four buses to reach Kelapur. The applicant has filed domestic violence proceedings which are pending before the J.M.F.C., Armori. Considering the inconvenience caused to the applicant, she has prayed to transfer the petition which is pending at Kelapur Court to the Court at Civil Judge, Senior Division, Gadchiroli. 4.

The non-applicant is served. The applicant has filed affidavit on record about the service on the non-applicant stating that the father of the non-applicant has received the notice on 9.2.2024. The non-applicant is also served through e-mail and whats-app. The non-applicant is not present before the Court today though he is served.

The applicant is staying at Armori and domestic violence proceedings are pending before the Armori Court, the non-applicant is attending the said proceedings. Considering the distance from Armori to Kelapur and inconvenience caused to the applicant to travel from Armori to Kelapur without any escort, the petition which is pending before Kelapur Court is transferred to the Court of Civil Judge, Senior Division, Gadchiroli.
