The applicant has filed this application to transfer the Petition-A No.94 of 2024 filed by the nonapplicant before the Family Court, Yavatmal for Restitution of Conjugal Rights to Civil Judge Senior Division, Warora, District Chandrapur.

The applicant is staying at Warora. The learned counsel for the applicant has stated that the applicant is staying with her one and half year old son and old aged parents. She is not getting any maintenance and it is not possible for her to attend the Court at Yavatmal which is 160 KM away from Warora along with her small child. Hence, prayed to transfer the petition from Yavatmal Family Court to the Court of Civil Judge Senior Division, Warora, District Chandrapur. 3.
The non-applicant is served but failed to appear before the Court.

Heard the learned counsel appearing for the applicant.

The applicant is staying at Warora with her parents. She is having one and half year old son, who is staying with her. She is not doing anything and she cannot afford the litigation charges. For the aforesaid reasons, the application deserved to be allowed. 6.
Petition A- 94 of 2024 is hereby transferred to the file of Civil Judge Senior Division, Warora, district Chandrapur.
