The applicant has filed this application to transfer the Marriage Petition-A No.234 of 2024 filed by the non-applicant for grant of divorce before the 5th Joint Civil Judge Senior Division, Amravati to the Court of Civil Judge Senior Division, Nagpur.

The marriage of the applicant was solemnised on 06.05.2011. She is having two children out of the said wedlock. Since 2015, she is staying away from the nonapplicant along with her children. She is staying at Narkhed.

The learned counsel appearing for the applicant has stated that the non applicant has filed the petition before the Family Court, at Amravati for divorce. The applicant is staying at Narkhed and she is not conversant with the people in Amravati. Therefore, she has requested to transfer the Marriage Petition-A No.234 of 2024 pending before the 5th Joint Civil Judge Senior Division, Amravati to the Court of Civil Judge Senior Division, Nagpur, where she can engage a good lawyer. She is staying at Narkhed and the distance from Narkhed Kavita
53-mca (tr.) 857-24.odt 2/2 to Amravati and Narkhed to Nagpur is similar. She has to travel for attending the Court for same distance. The reason given is that as she wanted to engage good lawyer and she is not knowing the lawyer from Amravati and therefore she has requested to transfer the Marriage Petition-A No.234 of 2024 pending before the 5th Joint Civil Judge Senior Division, Amravati to the Court of Civil Judge Senior Division, Nagpur. The reason given by the applicant for transferring the petition is not sufficient as the applicant has to travel for the same distance to attend the Court, hence, the same is not acceptable. The application stands rejected.
