Learned counsel for the applicant submits that applicant has filed the present application for withdrawal of the instant application.

It is pertinent to note that on 15th September 2025, with the consent of both parties, this Court appointed Smt. Vasanti Naik, former Judge of the Bombay High Court, as the sole arbitrator and sought her consent and disclosure statement. Accordingly, the same was received by this Court vide communication SKNair

12-mca-956-24.odt dated 25th September 2025, and the Registry placed on record the consent and disclosure of the sole arbitrator. 3.

However, the applicant has now filed the present application seeking withdrawal of the instant application. The application is allowed, subject to the deposit of Rs. 10,000/- as a processing fee.

With this precondition, the application stands disposed of as withdrawn.
