The applicant has filed this application to transfer the petition bearing No.A/215/2024 which is pending before the Family Court at Akola to the Family Court, Nagpur.

The applicant is staying at Nagpur with her six years old son who is taking education at Nagpur. It is difficult for her to attend the Court at Akola and, therefore, she has requested to transfer the matter from Akola to Nagpur.

Learned Advocate for the non-applicant has opposed the application stating that the applicant can travel from Nagpur to Akola and the non-applicant is ready to bear her travelling charges. Hence he has prayed to reject the application.

The distance from Nagpur to Akola is near about 300 kilometers and it will be difficult for the applicant to travel with her son from Nagpur to Akola to attend the proceedings and domestic violence proceedings are already pending before the J.M.F.C. Court, Nagpur which the non-applicant has to attend. Considering the inconvenience caused to the applicant, the application is allowed.

mca1006.2024.odt The petition bearing No.A/215/2024 which is pending before the Family Court at Akola is transferred to Family Court, Nagpur. The application is allowed accordingly.
