Heard the learned Advocate for the applicant. None appears for the non-applicant though served.

The applicant has filed this application to transfer the proceedings viz. Petition No.A-235/2023 pending on the file of Principal Judge, Family Court, Nashik, which is filed by the non-applicant for divorce, to the Court of Civil Judge, Senior Division, Akot.

According to the learned Advocate for the applicant, the marriage of the applicant was solemnized on 6.6.2010. She has one daughter out of said wedlock. Since last 11 years she is residing at parental house at Akot. She is suffering from illness and is bedridden. 4.

The learned Advocate for the applicant pointed out from the petition filed by the non-applicant for divorce wherein it is stated that the applicant is bedridden and, therefore, the non-applicant has filed the proceedings for divorce.

The reasons given by the applicant are that she is staying at Akot with her daughter since last 11 years and she is suffering from rheumatism.

Considering the aforesaid facts and as the applicant is not medically fit to travel from Akot to Nashik, the application is allowed in terms of prayer clause (ii).
