The petition challenges the order dated 06.12.2023 passed by respondent no. 2- the Divisional Joint Registrar, Co-operative Societies, Amravati in Revision No. 73/2023 whereby the auction held by the Recovery Officer in the recovery proceedings was cancelled on the ground that the upset price was not revised after six months.

The contesting respondent no. 1, on instruction, fairly submits that the matter has been settled between the Bank as well as other the RR Jaiswal

2 7A-wp-3538-24.odt respondents and now he has no grievance with regard to the market price set in the auction. Since, respondent no. 1, who is the owner of the property did not dispute the auction rather the matter has been amicably settled between the parties, therefore the auction held by the Recovery Officer has been confirmed.

Therefore, in view of the statement made by learned counsel for the petitioner and respondent no. 1, the order dated 06.12.2023 passed by the Divisional Joint Registrar, Co-operative Societies, Amravati in Revision No. 73/2023 is hereby set aside.

The auction held by the Recovery Officer is hereby confirmed.

The petition is disposed of in the above terms.

WRIT PETITION NO. 3538 OF 2024 7.

In view of the order passed in the above Writ Petition No. 205/2024, nothing survives in this petition and it is disposed of accordingly.
