THE HON'BLE MINISTER, THROUGH ITS SECRETARY, DEPARTMENT OF REVENUE AND GENERAL ADMINISTRATION, MANTRALAYA, MUMBAI AND OTHERS -------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Court's or Judge's Order Coram, appearances, Court's Orders or directions and Registrar's order --------------------------------------------------------------------------------------------------------- Shri U. P. Dable, Advocate for petitioner.

Shri A. M. Kadukar, AGP for respondent Nos.1 to 3 and 5. CORAM: ANIL S. KILOR AND AJIT B. KADETHANKAR, JJ.

DATE : 25/08/2025.

1.

In the present petition, the petitioner is praying for direction to the Hon'ble Minister to decide the revision application of the petitioner pending before the Hon'ble Minister.

2.

It is pointed out that the ancestral property of the petitioner came to be auctioned and the possession of the same was taken. It is argued that thereafter, the house of the petitioner came to be demolished.

3.

It is argued that to seek declaration that such action is illegal, a Revision application was filed before the Hon'ble Minister and the same is pending since 12/04/2023 and no decision is taken on it.

2 3-WP-258-2025.odt 3.

It is pointed out that considering the seriousness of the matter, the Hon'ble Minister ought to have decided the revision application within a reasonable time.

4.

Considering the prayer of the petitioner and as finding that since last two years, revision application is pending before the Hon'ble Minister and no decision is taken on such revision application, we are of the opinion that the direction sought in the petition needs to be granted.

5.

Accordingly, we dispose of the present writ petition with directions to respondent No.1 - Hon'ble Minister, Department of Revenue and General Administration, Mantralaya, Mumbai, to decide the revision application of the petitioner at the earliest and not beyond the period of one month from the date of supply of copy of this order, in accordance with law.
