Heard Mr. K.V.Bhoskar, learned counsel for the petitioner and Mr. Abhijeet Mate, learned AGP for respondent nos.1 to 3.

The learned counsel for the petitioner would submit that the petitioner has assailed the order passed by Deputy Commissioner (Supply) Nagpur Division, Nagpur dated 30.1.2018 on the ground that the petitioner was acquitted by the Competent Court. The petitioner's licence was cancelled which was issued under the provisions of the Maharashtra Scheduled Commodities (Regulation of Distribution) Regulations, 1975 on registration of an offence punishable under Section 7 of the Essential Commodities Act. The petitioner was acquitted from the charges levelled against him and, therefore, he prayed that the order passed by the respondent no.2 needs to be set aside by directing the authority to renew the licence of the petitioner. 3.

Per contra, Mr. Mate, learned AGP for the respondent nos.1 to 3 stated that against the order passed by the Deputy Commissioner, the petitioner is having an alternate and equally efficacious remedy by filing an appeal before the competent authority.

In view thereof, on the ground of availability of an alternate and equally efficacious remedy, the petition is dismissed.

The delay caused while prosecuting the present petition needs to be considered by the Appellate Authority while considering the application for condonation of delay from the date of filing of the petition.
