The present petition is filed against the order dated 22.09.2021 passed by the Learned District Judge-1, Washim in Regular Civil Appeal No.32/2013 whereby, the appeal filed by the petitioner was dismissed-in-default.

Learned counsel for the petitioner stated that on earlier occasion also, the appeal was dismissed-indefault. The application was filed for restoration and the Learned District Judge, Washim allowed the application. But even subsequently nobody remained present and therefore, appeal came to be dismissed-in-default. 3.

After making enquiry with the learned counsel for the petitioner, he makes a statement that no application was filed for restoration of appeal. In view thereof, the writ petition is disposed of, with liberty to the petitioner to file an application for restoration before the Concerned Court. Accordingly, the writ petition is disposed of.
